International Law and Conflict: An Enduring Tension?

The European Society of International Law (ESIL) is delighted to announce that its 2026 Annual Conference will take place at the Faculty of Law, University of Málaga, under the overarching theme International Law and Conflict: An Enduring Tension?

From its very inception, international law has been shaped by the need to address and contain conflict. While the aspiration of peaceful coexistence and cooperation among nations has remained central, today’s international order is marked by renewed tensions and systemic challenges. Political polarization, the rise of populist movements, conspiracy narratives, and radicalization are increasingly undermining multilateral institutions and eroding confidence in the international legal framework. These dynamics not only fuel confrontation between states and non-state actors but also call into question the very effectiveness and legitimacy of international law.

The conference seeks to engage critically with the multiple dimensions of this enduring tension. In recent years, we have witnessed how ideological extremism and intolerance destabilize democratic societies, fueling hostile attitudes towards human rights and the rule of law. At the same time, economic and trade relations are increasingly weaponized, as illustrated by the paralysis of the WTO’s dispute settlement mechanism, the rise of unilateral sanctions, and growing frictions among the world’s major economic actors. These developments have deep repercussions for global equity, development, and the protection of vulnerable populations.

The persistence of armed conflict further highlights the urgency of reassessing the role of international law. Contemporary conflicts have evolved beyond the traditional categories of interstate and civil wars to embrace hybrid, asymmetric, and polycentric forms involving a variety of actors, including terrorist groups, mercenaries, and private military companies. This changing reality strains the ability of international humanitarian law and international criminal law to adapt, leaving critical questions of accountability and enforcement unresolved.

Alongside these challenges, new domains of conflict have emerged. The exponential growth of information and communication technologies, together with the transformative potential of artificial intelligence, has multiplied threats in cyberspace. Disinformation campaigns, election interference, cyberattacks on critical infrastructure, and the increasing deployment of autonomous systems in warfare all pose pressing questions for the regulation of international relations. These developments cut across every area of international law, from security and human rights to trade and environmental protection, demanding innovative legal responses and international cooperation.

Against this background, the ESIL 2026 Annual Conference will provide a unique forum for scholars, practitioners, and policymakers to reflect on how international law confronts conflict in its many forms. By revisiting fundamental concepts and examining contemporary crises, the conference aims to illuminate paths for reinforcing the effectiveness, legitimacy, and fairness of the international legal order.

Málaga, with its long history as a crossroads of cultures and ideas, offers a fitting setting for such a conversation. The Faculty of Law at the University of Málaga looks forward to welcoming participants from around the world to engage in a rich and interdisciplinary dialogue on one of the most pressing issues of our time.

La segunda edición del Congreso Insternacional Pasado, presente y futuro: Los derechos y "no derechos" de la mujer, se centra en analizar la evolución de los derechos de la mujer en el derecho histórico, destacando los avances y desafíos que persisten. El estudio de la condición jurídica de la mujer es uno de los capítulos más relevantes de nuestra Historia del Derecho y podemos atrevernos a decir que uno de los más interesantes y atractivos de la historia de la civilización⁠. 

A pesar de que las investigaciones sobre la historia de la mujer han avanzado considerablemente en los últimos años, aún queda mucho por saber y conocer desde la perspectiva jurídica. Se trata de una cuestión compleja que merece un estudio de conjunto de la normativa de diferentes épocas, desde el Derecho romano hasta la actualidad. Ello va a posibilitar, mediante el análisis comparado, obtener nuevas conclusiones, y constatar la realidad que han vivido las mujeres en distintos periodos históricos.

Proponemos estudiar la condición jurídica de la mujer en distintos ámbitos jurídicos y etapas de la historia con el fin de aproximarnos a sus derechos y “no derechos”, determinados tanto por su propia condición natural y social como por su estado civil.

Buscamos crear un espacio de intercambio y discusión sobre la evolución de la condición jurídica de la mujer, así como los desafíos y barreras a las que se enfrentan, desde diferentes perspectivas. Te animamos a presentar comunicaciones dedicadas a estas cuestiones y a aportar nuevas perspectivas.

EL I CONGRESO INTERNACIONAL CICLAW: DERECHO Y CIENCIA CIUDADANA responde al impulso europeo actual hacia el fortalecimiento de la participación ciudadana en todos los ámbitos del conocimiento, incluido el jurídico, legal y regulador.

EL I CONGRESO INTERNACIONAL CICLAW: DERECHO Y CIENCIA CIUDADANA es un encuentro interdisciplinar que se propone ampliar la comprensión sobre las posibilidades de la ciencia ciudadana en nuevos campos del saber, como el Derecho. En efecto, la sociedad civil constituye una parte esencial de las infraestructuras científicas, dado que la ciudadanía puede colaborar eficazmente con la comunidad científica y, de hecho, así lo está haciendo hace años en miles de proyectos relacionados con otros saberes, como en ciencias de la salud, ciencias ambientales, de la computación, etc. Sin embargo, cualquier persona puede contribuir activamente en la investigación científica del Derecho, ya sea aportando datos, conocimientos o recursos.

EL I CONGRESO INTERNACIONAL CICLAW: DERECHO Y CIENCIA CIUDADANA propone incorporar los recursos utilizados comúnmente por la ciudadanía, como las aplicaciones móviles, por ejemplo, a los recursos científicos ya estandarizados y profesionalizados, como bases de datos o plataformas de Ciencia Ciudadana, españolas o extranjeras.

EL I CONGRESO INTERNACIONAL CICLAW: DERECHO Y CIENCIA CIUDADANA pretende testimoniar que la participación de los ciudadanos en la investigación científica del Derecho promueve y consolida la inclusión y la sostenibilidad, fortaleciendo la relación entre ciencia, sociedad y políticas públicas.

Este I CONGRESO INTERNACIONAL CiCLAW: DERECHO Y CIENCIA CIUDADANA, absolutamente pionero en España, constituye el foro y la sede idónea para compartir experiencias y conocimientos; para aprender y difundir nuevos proyectos e ideas. En consecuencia, se dirige a un público amplio y diverso: estudiantes, ciudadanía, operadores jurídicos, académicos, profesores e investigadores de las ciencias jurídicas y otras ciencias, pues la interdisciplinariedad de la investigación científica constituye una obligación, si de avanzar y mejorar se trata.
